Terms of service
The agreement between you and ProxyPanda, in the plainest English we could manage without losing the meaning.
1. Who we are
These terms are between you and Unidatum LLC (“ProxyPanda”, “we”, “us”), operator of proxypanda.io. By creating an account or using the service you agree to them.
2. What the service is
We provide residential, ISP and datacenter proxies, and list web data APIs. You buy a balance and spend it on those products. Residential is billed by traffic, which we meter per request; ISP and datacenter proxies are rented per IP for a term you choose; the data APIs, when they open, are billed per thousand requests.
We do not guarantee that any particular website will accept our IPs. Proxy access is a network service, not a promise about how third parties will treat your traffic.
3. Your account
- You are responsible for keeping your credentials secret.
- Traffic used through your credentials is billed to you, including traffic from someone who obtained them from you. Tell us immediately if you think they have leaked and we will rotate them.
- One person or organisation per account. Reselling requires our written agreement.
4. Billing
- All prices are in US dollars and are charged against a prepaid balance.
- For traffic-billed products we bill response bytes plus response headers, measured at our proxy. Request bytes are not billed.
- Connection failures, meaning timeouts, connection resets and errors returned by our own gateway, are billed at zero and recorded on your usage log as free. Any response the destination sends back, including an error page, a block page or a captcha, is traffic and is billed.
- Balances do not expire and carry no monthly fee.
- The rate per unit depends on the size of the order, as listed on the pricing page for each product. Renewing an ISP or datacenter IP is charged at that product’s entry rate, whatever rate the original order was charged.
If your own measurement of traffic differs from ours by more than 1%, tell us. We will re-bill the session at your figure, credit the difference back to your account as a service credit, and investigate afterwards.
5. Acceptable use
Use of the service is subject to our acceptable use policy, which forms part of these terms. Breaching it is grounds for immediate suspension.
6. Refunds
Unused balance is refundable for 30 days under our refund policy. Traffic already used is not refundable; where we caused the failure, we credit that traffic back to your account as a service credit. A refund is only ever paid back to where the money came from: a card top-up to that card, a crypto top-up to the wallet it was sent from, in the same coin. Where that card can no longer take it, or a crypto payment came from an exchange, the refund policy says where it goes instead. We do not refund as account credit or to any other destination.
7. Availability
We aim for continuous availability and publish incidents to #status in our Discord. We do not offer a contractual uptime guarantee, and we are not going to pretend to — we are a small provider at a low price point. Where an outage burns your traffic, we credit that traffic back to your account.
8. Liability
To the extent permitted by law, our total liability to you for any claim is limited to the amount you paid us in the three months before the claim arose. We are not liable for lost profits, lost data, or consequential loss.
Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.
9. Ending it
- You can stop at any time. Within 30 days of a top-up you can ask for its unused portion back, as the refund policy describes.
- We can suspend or close an account that breaches the acceptable use policy, and we will tell you why.
- If we close your account for any reason other than fraud against us, you get your whole unused balance back, however long ago you topped it up, paid to where it came from as the refund policy describes. A balance that was itself paid for fraudulently is never refunded.
- If we end an ISP or datacenter IP rental before its term is up, for reasons of our own rather than a breach of these terms, the part of the term not yet used is refunded pro rata, to where the money came from.
10. Changes
We will post material changes to these terms at least 14 days before they take effect, and announce them in Discord. If you do not accept a change, ask for your balance back: the whole unused balance, however long ago you topped it up, paid to where it came from as the refund policy describes, unless that balance was itself paid for fraudulently.
